A man has been sentenced to 10 years and three months in prison following the fatal mauling of his mother-in-law by his XL bully dog.
The incident occurred on February 3, 2024, at the residence of Ashley Warren in Jaywick, Essex, where his dog, Bear, attacked 68-year-old Esther Martin. At the time, Martin was caring for two adult dogs, eight puppies, and a child while Warren was in London filming a music video.
Warren, 41, received his sentence at Chelmsford Crown Court, marking him as the first individual charged under new laws concerning XL bully dogs. The court was informed that Bear had not been taken for a walk in the four weeks leading up to the attack.
„I am sure that you could and should have reasonably foreseen the risk,“ stated Mr. Justice Jeremy Johnson KC. „As well as knowing it was prohibited, you knew it had been pent up in the house for weeks, you knew it was capable of being aggressive and you knew Esther Martin could not control it.“
In addition to his prison term, Warren has been permanently banned from dog ownership.
Details of the Incident
Esther Martin, a grandmother from Woodford Green in East London, had traveled to Warren’s home to assist with the dogs. Her daughter Clare had been in a long-term relationship with Warren until her unexpected passing in 2021.
Prosecutors described the situation as „a tragedy waiting to happen,“ given Martin’s physical limitations due to a hip replacement, arthritis, and a limp, standing at just 5 feet 3 inches tall.
During the court proceedings, it was revealed that the puppies may have instigated a fight, prompting Martin to use a broom in an attempt to separate them. Unfortunately, the two adult dogs responded by attacking her, leading to her death.
Warren’s Awareness of the Situation
Evidence presented in court indicated that Warren was aware of the dogs‘ potential danger. On January 31, 2024, he chased Bear outside after the dog escaped, with CCTV footage capturing his struggle to control the animal. The day prior, he had expressed in a message that the dogs were „too much for me.“
Police had visited Warren a week before the incident, during which he falsely claimed to possess exemption paperwork for Bear, which he had allegedly purchased online.
While testifying, Warren maintained that he could not have foreseen „in a million years“ that his „gentle“ dogs would harm anyone.
Following the attack, both Bear and another dog, Beauty, were euthanized at the scene, and the puppies were later destroyed.
Legal Proceedings and Sentencing
Warren was informed of the attack at 3:37 PM on February 3, and he was arrested upon his arrival at Clacton railway station. The jury found him guilty of being the owner of a dog that caused injury resulting in death while dangerously out of control in a private setting. However, he was acquitted concerning the second adult dog, Beauty, as it was determined she belonged to his girlfriend.
Additionally, Warren was convicted of possessing a knife, which was discovered during his arrest. Following the sentencing, members of Martin’s family expressed their relief and support, with some in the public gallery reacting emotionally.
Sonia Martin-Coppen, Esther Martin’s daughter, shared in a victim impact statement, „[The] last conversation I had with her was about setting a date for my wedding… I’ve missed out on my mum seeing me in my wedding dress.“
In a joint statement delivered outside Chelmsford police station, Martin-Coppen and her sister Kelly Fretwell remarked, „[The sentence] is validation of the pain we have endured and a step towards protecting other families from the same nightmare.“

Detective Chief Inspector Louise Metcalfe from Essex Police described the investigation as „challenging and complex,“ highlighting its significance as the first case of its kind following recent legislative changes regarding XL bully dogs.
