Settlement Reached in Nurse’s Controversial Case Involving Transgender Patient

A nurse from South London has successfully reached a settlement with the NHS trust that suspended her over an alleged violation of a transgender patient’s confidentiality.

Jennifer Melle, a resident of Croydon, was removed from her duties after publicly discussing a warning she received for using incorrect pronouns. On Monday, she expressed her relief, stating, „I cannot discuss the terms of the settlement, but generally I am glad that my employer has finally decided to extend an olive branch to me.“

Background of the Incident

The Epsom and St Helier Hospitals NHS Trust agreed to settle Melle’s claim just before a tribunal was scheduled to begin. The trust expressed regret over her experience, stating they were „sorry“ for the situation.

In May 2024, Melle faced racial abuse from a transgender woman, who was assigned male at birth, after she referred to them as „Mr.“ Following this incident, Melle received a written warning but continued her work. The NHS trust also communicated with the patient, emphasizing that threatening and racist behavior would not be tolerated.

Suspension and Reinstatement

Despite the initial warning, Melle was suspended with full pay in March 2025 after she spoke to the media about her experiences. The trust raised concerns that the patient could potentially be identified through media reports, which could lead to a breach of confidentiality.

Melle remarked, „The situation should never have come to this.“ She further stated, „No nurse or other medical professionals should ever have to face what I have faced simply for telling the truth, doing their job, and reporting racist abuse and physical threats from a patient.“

In January, Melle was reinstated to her clinical duties following a private disciplinary meeting that concluded no further action would be taken regarding the alleged breach of confidentiality.

Continuing Challenges

Reflecting on her ordeal, Melle described the experience as „the darkest days of my life“ and noted that the situation is still ongoing. She is currently under investigation by the Nursing and Midwifery Council (NMC).

A representative from Epsom and St Helier Hospitals NHS Trust reiterated their stance, stating, „Racial abuse of our staff is never acceptable, nor is discussing a patient’s private medical information publicly. We are sorry that Miss Melle had this experience and we issued a written warning to this patient, but we expect all staff to maintain patient confidentiality at all times.“

The NMC has been contacted for further comments regarding the ongoing investigations.
