A woman has been found guilty of damaging her neighbor’s wisteria plant and subsequently assaulting her with a crutch. Atidel Boutara Cook, 50, was convicted of criminal damage and assault following an incident that occurred last December.
The case was heard at Highbury Magistrates‘ Court, where it was revealed that Cook had denied both charges. The court learned that after being confronted by her upstairs neighbor, Pei Wong, about the destruction of the plant, Cook reacted violently. She reportedly swore at Wong and struck her once on the forehead and twice on the chest with her crutch.
Details of the Incident
Wong and her husband, Louis Scott, own the freehold of their Victorian house in Tottenham, where they reside on the upper floor, while Cook lives in the ground-floor flat. According to Wong, her husband witnessed Cook cutting down the wisteria and uprooting other plants in their shared front garden.
The couple, who had lived next to Cook for 20 years without much interaction, decided to confront her together. Wong recorded the encounter on her phone, capturing the escalating situation.
Witness Testimonies
Scott testified that they approached Cook in a calm and polite manner to express their dissatisfaction with her actions. However, he described Cook as having „rather lost control of herself,“ stating that she began to scream and wave her arms before grabbing Wong’s phone. He recounted, „She also then came up to my wife and struck her a number of times with her crutch.“ Scott expressed concern for his wife’s safety during the incident, noting that he had to catch her as she fell backward after being hit.
„I would say that I was shaking. I couldn’t believe she repeatedly continued to hit me even though I didn’t say a single word to her,“ Wong said, reflecting on her feelings during the attack.
Evidence Presented in Court
Video footage from Wong’s phone was shown in court, depicting Cook standing outside the front door with large garden shears. In the background, Scott can be heard expressing his dismay at Cook’s actions. The video abruptly ends with the phone dropping to the ground, followed by sounds of shouting and what the judge described as a „metallic-like sound, thumping on to Ms. Wong which was consistent with the sound of a crutch.“
Cook’s Defense and Court Proceedings
During the court proceedings, Cook, who appeared with a red walking frame, admitted to cutting the wisteria but claimed that the plant was „dead“ and negatively impacting the air quality in her flat. The judge admonished Cook on two occasions for interrupting while Wong and Scott provided their testimonies.
„I’m not here to litigate 20 years of problems between neighbors,“ the judge stated. He advised Cook to maintain distance from Wong and released her on conditional bail, with sentencing scheduled for May 6 at the same court.
This case highlights the tensions that can arise between neighbors and the potential for disputes to escalate into violence.
