The voice of the affected residents resonates strongly as they confront the harsh realities of rising rents and potential evictions. Mae Oroszlany, a long-time resident of Bermondsey’s St James Estate, described the situation as „constant pressure“ after receiving a Section 21 eviction notice just hours before a new law aimed at banning such notices came into effect on May 1. This change has left many tenants feeling vulnerable, facing the possibility of financial ruin or homelessness.

Following the acquisition of the estate by BMR Group, tenants have been hit with rent increases of up to £500 per month. In a letter addressed to Freshview, the management company overseeing the estate, Southwark Council leader James McAsh urged the firm to halt all eviction proceedings and provide more realistic rental terms. He emphasized that the impending deadline leaves residents with an „impossible choice“ regarding their housing.

Freshview defended its actions, stating that the previous rents were „substantially below“ market value and that the Section 21 notices were issued as a precautionary measure. However, this has not alleviated the anxiety among long-standing tenants, many of whom are now grappling with uncertainty about their living situations.

Impact on Long-Term Residents

Mary Knight, another resident who has lived on the estate since 2003, expressed her distress over a proposed £524 monthly rent increase, which would raise her payments from £1,376 to £1,900 for her two-bedroom home. „It was a bit of an eye-opener. I suddenly realized that I was potentially being made homeless because I would not have been able to afford that,“ Knight said. As a mother of two, she highlighted the overwhelming nature of navigating the legal complexities without adequate support.

„There are so many times that I just wanted to stop,“ she admitted. „But I can’t stop, because to go and find somewhere else to live, you now have to have something like £50,000… or a guarantor.“ This sentiment reflects the broader struggle faced by many tenants in the area.

Community Response and Concerns

Asha Garway, secretary of the St James‘ Tenants Association, raised concerns about the landlord’s intentions, suggesting that the goal may be to convert family homes into houses in multiple occupation (HMOs) to maximize profits. „They can turn a three-bedroom property into six to eight-bedroom properties… doubling their profit and kicking families out,“ Garway stated.

In response to these allegations, a spokesperson for Freshview clarified that while individual properties are periodically reviewed, there is „no proposal to convert the estate as a whole into HMOs.“ They also noted that a review conducted after BMR Group’s acquisition found a significant number of homes were being rented at rates substantially below market value.

Legal and Ethical Implications

David Watson, Southwark Council’s executive member for community safety and engagement, acknowledged that while the landlord’s actions are legally permissible, the timing raises ethical questions. „Unfortunately, the landlord’s actions are legal,“ Watson remarked. „They imposed these notices the day before the government changed the law in order to ban no-fault evictions.“ This timing has sparked outrage among residents and advocates alike.

Freshview’s spokesperson further stated that recent rulings from the First-tier Tribunal have confirmed that the proposed rent increases align with market rental values. They also mentioned that any rent rises are not being enforced while tribunal cases remain ongoing. Renewal agreements have been offered in 20 of the 32 remaining Section 21 cases after discussions with tenants, with rents below current market value.

Despite the challenges, Freshview expressed its intention to continue investing in the estate and collaborating with residents and Southwark Council to secure its long-term future. The situation remains fluid, with residents advocating for their rights and seeking stability in an increasingly precarious housing market.
