What actions can a parent take when a family outing goes awry? A father of four is initiating legal proceedings against Hamleys after sustaining injuries from a substantial piece of Perspex that fell from a height while he was Christmas shopping.
Jonathan Joseph, 43, was shopping with his family at the Regent Street flagship store when an alarming incident occurred. He was on the escalator when he was alerted by screams and instinctively believed that a ‘shard of shattered glass’ was descending towards them.
In a moment of quick thinking, he pushed his daughter to safety and positioned himself to absorb the impact aimed at a pram situated behind him. Subsequently, it was revealed that he had been struck by a 4-foot sheet of heavy clear Perspex that had detached from the escalator two floors above.
The self-employed window fitter incurred a leg injury that necessitated a leave of absence from work. He is now pursuing legal action against the renowned toy company, asserting that he „could have been killed“ during the incident, which he describes as a „Christmas miracle“ that no one was severely harmed.
Details of the Incident
Joseph, from Edmonton, London, stated, „It was massive and I instantly knew it could be game over. I wasn’t a hero; I just did what every other dad would do and reacted instinctively. A children’s toy store should be the safest place in the world. But it wasn’t.” The incident left his family shaken as they were out for a festive day.
According to Joseph, prior to the accident, he and his family had been eagerly visiting all seven floors of Hamleys, allowing the children to select their favorite toys. The incident unfolded as they were about to exit the escalator on the first floor.
He recounted the moment, saying: “I heard shouting, screaming and a massive commotion coming from above. I looked up and it was terrifying to see what looked like a huge shard of glass coming towards us. I knew if that hit a child or me, we would be dead.”
Aftermath of the Accident
Joseph recounted the agony he experienced as the heavy Perspex struck his leg. He initially thought it would shatter upon impact. The injury inflicted intense pain to his right leg, limiting his ability to walk properly.
Store personnel provided immediate care, assisting him with ice packs. Following the incident, he visited a walk-in clinic where he was prescribed strong pain medication and was unable to participate in leisure activities, such as playing football—a sport he had been involved in since his youth.
Moreover, the injury overshadowed the Christmas spirit for his children, as he was unable to procure any of the gifts they had chosen earlier that day. This contributed to feelings of guilt for Joseph, who expressed, „I felt really guilty; I could not get my kids any of their Christmas presents they wanted. This made me feel like I ruined Christmas and let my kids down.“
The renowned toy retailer, established in 1760, operates 176 franchises globally and maintains 11 stores throughout the UK. Joseph’s experience has raised questions about safety protocols within the store, especially in light of the incident.
He remarked, „I couldn’t stop thinking about what happened and how close we came to being seriously injured. I wanted to make people aware in case something similar happens again anywhere. The more I thought about it, the more I knew I had to do something.“
Joseph has reached out to Express Solicitors, a firm specializing in accidents. Isabella Greenslade, an injury specialist at the firm, commented: „This was supposed to be a magical family day out, but it quickly turned into a nightmare before Christmas. It is just sheer luck that Jonathan and his family weren’t more seriously injured. Big brands need to maintain their stores to ensure they are safe for customers, particularly during busy holiday periods.”
In response to the incident, Hamleys issued a statement affirming their commitment to customer and staff safety: „Hamleys takes the safety of customers and staff extremely seriously. An investigation has been launched, and we’re unable to comment further at this stage.“
